“An Astounding, If Long-Overdue, Victory for Justice:” UUSC Applauds the Release of Eight Honduran Human Rights Defenders

Cambridge, MA—In a stunning reversal, coming just one day after six Honduran human rights defenders were wrongfully convicted on false charges, the Constitutional Chamber of the Supreme Court of Honduras has now effectively overturned the rulings against all six individuals. They should soon be released—alongside two other defenders who were previously acquitted. Upon hearing the news on February 10, UUSC’s President Rev. Mary Katherine Morn issued the following response:

“This is an astounding, if long-overdue, victory for justice. Only yesterday, we feared the worst, after six human rights defenders were judged guilty on flagrantly trumped-up charges. Now, scarcely 24 hours later, our hearts are full of hope as we learn that all eight detained Guapinol water defenders, including the six wrongfully convicted individuals, should be released. This follows the successful resolution of legal petitions they first filed with the Honduran Supreme Court in 2020 and 2021. We celebrate their impending return home and honor their struggle and dedication to justice.

“From the very beginning, the prosecution and detention of the Guapinol water defenders was a travesty of justice. These men were singled out solely because they dared to advocate on behalf of the rights and safety of their communities. Their conviction on Wednesday was part of an ongoing effort to silence their legitimate activism; for this reason, it was swiftly and rightly condemned by international human rights observers as a blatant violation of the rights to expression and assembly.

“Today’s decision, which reverses those outrageous convictions, is to be celebrated. At the same time, we recognize that this modicum of justice was not bestowed; it was won through arduous advocacy. We applaud our partners in Honduras, the communities that rely on water from the Guapinol river, and above all the defenders themselves and their legal team, who refused to give up or stop fighting for their rights.

“We also recognize that this struggle is far from over. The company that owns the iron oxide mine on the Guapinol River, which has masterminded the smear campaign against the defenders, will not stop here. No doubt, they will pursue other tactics to try to silence and intimidate those who speak out against the damage their project is inflicting on nearby communities.

“Moreover, the successful resolution of the petitions before the Supreme Court does not mean the entrenched corruption in much of the Honduran state and judiciary is resolved. The Supreme Court’s decision to dismiss the charges against the eight defenders is most welcome, but it would never have been necessary if the Honduran authorities had not wrongfully charged, prosecuted, and detained them in the first place.

“UUSC will continue to join our Honduran partners in advocating for long-term justice for human rights defenders and environmental activists in Honduras, including reparations for the Guapinol defenders and accountability for those responsible for their arbitrary detention. This work is no less urgent today than yesterday. But we also pause to honor—in solidarity with our partners—this brief moment when justice was finally served and join in the celebrations to welcome the defenders home to their families and communities.”

“Una victoria asombrosa, aunque tardía, para la justicia:” UUSC aplaude liberación de ocho defensores de derechos humanos hondureños

Cambridge, MA—En un cambio sorprendente, tan solo un día después de que seis defensores de derechos humanos hondureños fueran injustamente declarados culpables de cargos falsos, la Sala de lo Constitucional de la Corte Suprema de Justicia de Honduras efectivamente anuló los fallos contra las seis personas. Pronto deberán ser liberados, junto con otros dos defensores que fueron absueltos previamente. Al escuchar la noticia el 10 de febrero, la presidenta de UUSC, la reverenda Mary Katherine Morn, emitió la siguiente respuesta:

“Esta es una victoria asombrosa, aunque tardía, para la justicia. Justo ayer nos temíamos lo peor, después de que seis defensores de los derechos humanos fueran declarados culpables de cargos flagrantemente falsos. Ahora, apenas 24 horas después, nuestros corazones están llenos de esperanza al enterarnos de que los ocho defensores del agua de Guapinol detenidos, incluidos los seis condenados injustamente, deben ser liberados. Esto debido a la resolución favorable de los recursos que se presentaron ante la Corte Suprema de Justicia de Honduras en 2020 y 2021. Celebramos su inminente regreso a casa y reconocemos su lucha y dedicación a la justicia.

“Desde el principio, el enjuiciamiento y la detención de los defensores del agua de Guapinol fue una parodia de la justicia. A estos hombres se les señalaron únicamente por haberse atrevido a defender los derechos y la seguridad de sus comunidades. La sentencia condenatoria del miércoles fue parte de un esfuerzo continuo para silenciar su activismo legítimo; por esto, de inmediato y con toda la razón, observadores de derechos humanos alrededor del mundo lo denunciaron como una flagrante violación de los derechos de expresión y reunión.

“La decisión de hoy, que revierte esas indignantes convicciones, es digna de celebración. Al mismo tiempo, hay que reconocer que este mínimo de justicia no fue regalado; se ganó a través de una ardua defensa. Aplaudimos a nuestras copartes en Honduras, a las comunidades del río Guapinol, y sobre todo a los propios defensores y su equipo legal, quienes se negaron a rendirse o desistir en la lucha por sus derechos y la verdad.

“También sabemos que esta lucha está lejos de terminar. La empresa propietaria de la mina de óxido de hierro en el río Guapinol, que ha orquestado la campaña de desprestigio contra los defensores, no se detendrá aquí. Sin duda, buscarán otras tácticas para tratar de silenciar e intimidar a quienes denuncian el daño que su proyecto está haciendo a comunidades cercanas.

“Además, la resolución exitosa de las peticiones ante la Corte Suprema no significa que la corrupción arraigada en gran parte del Estado y el poder judicial hondureño haya desaparecido de un día para otro. La decisión de la Corte Suprema de desestimar los cargos contra los ocho defensores es muy bienvenida, pero nunca habría sido necesaria si las autoridades hondureñas no los hubieran acusado, procesado y detenido indebidamente en un primer lugar.

“UUSC seguirá en pie de lucha al lado de nuestras copartes hondureñas para exigir justicia a largo plazo para las y los defensores de los derechos humanos y activistas ambientales en Honduras, incluyendo reparaciones para los defensores de Guapinol y la rendición de cuentas para las personas responsables de su detención arbitraria. Este trabajo no es menos urgente hoy que ayer. Pero también hacemos una pausa para honrar, en solidaridad con nuestras copartes, este momento en que finalmente se hizo justicia y nos unimos a las celebraciones para abrazar y dar la bienvenida a los defensores que por fin regresarán a sus familias y comunidades.”
